English summary: Subsumption is a term which enjoys a long tradition in jurisprudence and which can be traced back to an established use in logic. Unlike in logic however the subsumption process is a contentious issue in legal methodology, since there is not even an agreement on the meaning of the term. This varies depending on the location, standpoint, and linguistic usage of the user. In this volume, various philosophical and legal scholars, all of whom are well-versed in methodology, state their positions ranging from the Aristotelian approach and Kant's and Hegel's concepts to current model methodologies of hermeneutic, pragmatic, phenomenological and rhetorical legal theory.
