Diego P. Fernández Arroyo, Professeur à l'Université Complutense de Madrid, relève en introduction de son cours que les critères sur lesquels les autorités fondent leur compétence pour des litiges relatifs aux affaires privées internationales sont parfois difficiles à justifier. Partant de ce constat, le Professeur Fernández Arroyo consacre son cours à l'analyse de ces chefs de compétence et de leur application, ainsi qu'à l'étude des alternatives qui ont été proposées et d'autres qu'il propose pour l'avenir. Dans un premier temps, le Professeur Fernández Arroyo étudie les justifications de l'attribution de la compétence judiciaire, puis s'intéresse à la théorie et à la pratique relative aux fors exclusifs et aux fors exorbitants. À la suite de ces développements, il analyse comment sont actuellement traités ces chefs de compétence par les législateurs (internationaux et nationaux et les juges). Il propose enfin quelques alternatives.

Co-operative Efforts in Private International Law on Behalf of Children: The Hague Children's Conventions

In this course on the co-operative efforts in private international law on behalf of children, Linda J. Silberman, Martin Lipton Professor at the New York University School of Law, is focusing on three child-centered Conventions that were the result of the Hague Conference on Private International Law: the 1980 Convention on the Civil Aspects of International Child Abduction, the 1993 Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption, and the 1996 Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children.
