»Preterintention and Legal Theory«The comparative study focuses on the interpretation of the crime »bodily harm resulting in death« from the viewpoint of legal theory developed by jurisdiction and academia in Germany and Italy. As a main challenge the author identifies the practical implementation of fault as a mens rea requirement. The study focuses on the offence of grossly negligent homicide as a pivotal point for the interpretation of the German and Italian offence and tries to suggest a specific solution suitable for both legal systems.
