Synopsis

Das Rechtsstaatsprinzip - The Rule of Law-Principleis the thematic priority of this volume of the Annual Review of Law and Ethics. The contributions give an overview of similarities and differences between both principles, that are often, and not quite correctly, thought to be mere translations of each other. Examinations concerning the foundations of both principles in this present volume, however, show that although the principles correlate with one another, their legal historical development was different and thus also the content of both principles may vary. Additionally, some articles deal with specific problems in adapting both principles. Furthermore, one section is devoted to the interpretation of Kant's legal and moral philosophy, in particular his work Metaphysics of Morals from 1797.
