Synopsis
This book discusses the various facets of partnership. With a preliminary chapter on brief history and definitions, the author goes on to discuss the nature of partnership, relations of partners to one another, relations of partners to third parties, incoming and outgoing partners, dissolution, and registration of firms. Certain principles relating to law of partnership have been recently interpreted in a new light. A joint venture has been construed judicially as an informal partnership. The personal property of a partner does not become a joint property by reason merely of its use in the business. It requires an agreement to that effect. The nature of a partner's share in the joint assets has been analysed. The courts have explored within the framework of the Partnership Act the possibility of preventing a misconducting partner from damaging the business and property of the firm. The courts have adopted a clear view that even an unregistered firm can be granted an injunction against such partner under Section 9 of the Arbitration and Conciliation Act, 1986.
