English summary: This current work dealing with the protection of business and trade secrets in civil procedures is intended not only for the individual business with a view to their competitive position but also for the preservation of competition in general. German civil procedure law scarcely offers this protection. In contrast, since the Federal Code of Civil Procedures came into effect, the legislature, case law and the academy have shaped a thorough system for the dissemination of information concerning civil procedures which has continued to expand to the present day. This legal position smoothed the way for quasi-legal industrial espionage. Based on these findings, Andreas Gotz places the system for the dissemination of procedural information next to a system for the procedural protection of secrets. He deals with the civil hearings process in its various characteristics together with the practical, meaningful, pre-trial dissemination of information as well as the enforcement proceedings.

German description: Der Schutz von Betriebs- und Geschaftsgeheimnissen ist nicht nur fur das einzelne Unternehmen mit Blick auf seine Wettbewerbsposition zentral, sondern auch fur den Erhalt von Wettbewerb schlechthin. Das deutsche Zivilverfahrensrecht bietet diesen Schutz kaum. Im Gegenteil: Der Gesetzgeber, die Rechtsprechung und die Wissenschaft formten seit Inkrafttreten der ZPO ein weitreichendes System der zivilprozessualen Informationsbeschaffung und bauen dieses bis heute bestandig aus. Diese Rechtslage ebnet den Weg zu gleichsam legaler Industriespionage. Ausgehend von diesem Befund stellt Andreas Gotz dem System der prozessualen Informationsbeschaffung ein System des prozessualen Geheimnisschutzes an die Seite. Er behandelt hierbei neben dem Erkenntnisverfahren in seinen verschiedenen Auspragungen die praktisch bedeutsame vorprozessuale Informationsbeschaffung sowie das Vollstreckungsverfahren.
